Clonium ("we," "us," "our") is operated by Viral Wizard LLC, a Florida limited liability company. Our website is clonium.ai. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use the Clonium platform and services (collectively, the "Service").
2. Information We Collect
Account and Contact Information
Information you provide directly when using the Service:
- Name, email address, and phone number
- Account credentials
- Payment and billing information (processed by third-party payment providers)
- Communications you send to us (support requests, feedback)
Customer Content
Media you upload or submit to the Service:
- Video and audio files uploaded for clone generation
- Images and photographs
- Text, scripts, and other content you provide
Biometric Data
When you upload video or audio content, we extract and process biometric data to generate AI clone outputs. This includes:
- Facial geometry — measurements and characteristics derived from facial features in uploaded video
- Voiceprint — acoustic characteristics and speech patterns derived from uploaded audio

Automatically Collected Information
- Device type, browser, and operating system
- IP address and approximate geographic location
- Pages visited, clicks, and interactions (via Google Analytics)
- Referral source and UTM parameters
- Cookies and similar tracking technologies
Public Social Media and Marketing Content
To power our content intelligence and viral analysis features, we process publicly available data from social media platforms and the internet, including:
- Publicly posted video and audio content, captions, and transcripts
- Public engagement metrics (views, likes, comments, shares)
- Public creator profile information and posting patterns
- Public advertising creative and marketing materials
This data is collected exclusively from public-facing URLs and does not involve accessing private accounts, using login credentials, or bypassing platform security measures. We do not collect private messages, non-public posts, or content behind authentication walls.
3. Biometric Data Notice
This section serves as our written policy and notice regarding the collection, use, and storage of biometric identifiers and biometric information as required by applicable state biometric privacy laws, including the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), the Washington Biometric Privacy Act, and similar laws.
What Biometric Data We Collect
- Facial geometry: mathematical representations of facial features extracted from uploaded video content, used to generate AI video clones that replicate the visual likeness of depicted individuals
- Voiceprint: acoustic models of speech patterns, tone, cadence, and vocal characteristics extracted from uploaded audio content, used to generate AI voice clones that replicate the voice of depicted individuals
Purpose of Collection
Biometric data is collected and processed solely to provide the Service you requested — specifically, to generate AI clone video content that replicates the likeness and voice of the individuals depicted in your Customer Content.
Retention and Destruction
- Free clone tool: All uploaded media and derived biometric data are automatically and permanently deleted within 24 hours of processing.
- Paid accounts: Biometric data is retained for the duration of your active account plus 30 days to allow for account reactivation. Upon account deletion or termination, biometric data is securely destroyed within 30 days.
- Upon request: You may request deletion of all biometric data at any time by emailing neal@quantumscaling.ai. We will comply within 30 days.
No Sale or Profit
We do not sell, lease, trade, or otherwise profit from biometric data. Your biometric data is never used for advertising, marketing, or any purpose unrelated to providing the Service.
Disclosure to Third Parties
Biometric data is shared only with the third-party AI processing providers listed in Section 5 below, solely for the purpose of generating your requested AI clone outputs. We require these providers to maintain appropriate data protection measures. We do not disclose biometric data to any other third party unless required by law or valid legal process.
Security
Biometric data is encrypted in transit (TLS 1.2+) and at rest. Access is restricted to authorized systems required to provide the Service. We maintain administrative, technical, and physical safeguards to protect biometric data from unauthorized access, disclosure, or destruction.
Consent
By uploading Customer Content containing biometric data, you confirm that you have read and understood this Biometric Data Notice and that you have obtained all required consents from every individual whose biometric data is included. If you are an Illinois resident, your use of the Service after reviewing this notice constitutes your informed written consent to the collection, use, and storage of biometric data as described herein.
4. How We Use Your Information
- To generate AI clone video and audio content from your Customer Content
- To deliver generated content via the platform, SMS, or email
- To process payments and manage your account
- To send transactional messages (confirmations, delivery notifications)
- To send marketing communications you have opted into
- To improve the Service, fix bugs, and develop new features
- To respond to your questions and support requests
- To detect and prevent fraud, abuse, and violations of our Terms
- To comply with legal obligations and respond to lawful requests
- To analyze publicly available content trends, engagement patterns, and viral metrics to power our content intelligence features
- To train and optimize our proprietary viral intelligence models, framework algorithms, and content scoring systems using de-identified text inputs, structural patterns, and aggregated performance metrics (biometric data is never used for model training)
We do not use your Customer Content or biometric data to train AI models for other users or purposes without your explicit written consent. Aggregated, de-identified usage statistics (not including biometric data) may be used to improve the Service.
5. Third-Party Service Providers
To provide the Service, we share certain data with third-party providers. Providers that may process Customer Content or biometric data:
- Video generation providers — for generating AI clone video content from facial geometry and reference media
- Voice synthesis providers — for generating AI voice clones from voiceprint data and audio references
Other service providers:
- Google Analytics — website analytics (anonymized usage data)
- Vercel — website hosting
- Supabase — data storage and authentication
- Twilio — SMS delivery
- Cal.com — appointment scheduling
- Payment processors — payment processing (we do not store payment card data)
- Social media platform APIs — public data collection for content intelligence (no authentication-based scraping)
Each provider operates under its own privacy policy. We select providers that maintain appropriate security measures and require them to process data only as instructed for the purposes described. We do not sell your personal information to any third party.
6. SMS Communications
If you provide your phone number, we may send you SMS messages including clone video delivery links and promotional content. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for assistance. Your mobile number will not be shared with or sold to third parties for marketing purposes.
7. Cookies and Tracking
We use Google Analytics and similar tools to understand how visitors use our site. These tools use cookies and similar technologies to collect anonymized usage data. You can control cookies through your browser settings. Disabling cookies may affect certain features of the Service.
8. Data Retention and Deletion
- Free clone sessions: Uploaded media and biometric data deleted within 24 hours
- Paid account data: Retained for the duration of your active account plus 30 days post-termination
- Contact information: Retained for marketing communications until you opt out or request deletion
- Analytics data: Retained in aggregated, anonymized form; not linked to individual biometric data
- Legal compliance: Certain records may be retained as required by law, even after account deletion

9. Data Security
We implement industry-standard technical and organizational measures to protect your personal information and biometric data, including:
- Encryption in transit (TLS 1.2+) and at rest
- Access controls limited to authorized personnel and systems
- Regular security reviews and monitoring
- Secure data destruction procedures for deleted content
No method of transmission or storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you in accordance with applicable law.
10. Your Rights
Depending on your location, you may have the following rights regarding your personal information:
All Users
- Access the personal data we hold about you
- Request correction of inaccurate data
- Request deletion of your data, including all biometric data
- Opt out of marketing communications at any time
- Opt out of SMS by replying STOP
California Residents (CCPA/CPRA)
If you are a California resident, you additionally have the right to:
- Know what personal information we collect, use, and disclose
- Request deletion of your personal information
- Opt out of the sale or sharing of personal information (we do not sell your data)
- Non-discrimination for exercising your privacy rights
- Limit use and disclosure of sensitive personal information
Illinois Residents (BIPA)
If you are an Illinois resident, you additionally have the right to:
- Receive written notice before collection of biometric data (provided in Section 3 above)
- Provide informed written consent before biometric data is collected
- Know the specific purpose and retention period for biometric data
- Request destruction of your biometric data
Texas Residents (CUBI)
If you are a Texas resident, we will not capture your biometric identifiers for a commercial purpose without first informing you and receiving your consent. We will not sell, lease, or otherwise disclose your biometric identifiers.
To exercise any of these rights, email neal@quantumscaling.ai. We will respond within 30 days (or sooner if required by applicable law).
11. Children's Privacy
The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information or biometric data from anyone under 18. The creation of AI clones of minors is strictly prohibited. If we learn that we have collected data from a person under 18, we will delete it promptly.
12. International Users
The Service is operated from the United States. If you access the Service from outside the US, your information will be transferred to and processed in the United States, which may have different data protection laws than your jurisdiction. By using the Service, you consent to this transfer and processing.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page with a revised "Last updated" date. For material changes — particularly changes to how we handle biometric data — we may also notify you by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated policy.
